A Study on Patient Safety Law and Clinical Ethics

Abstract
After in-depth discussion in Korea, Patient Safety Act, which was published January 28, 2015, will be effect on the July 29, 2016. This paper examines the legal institutionalization in the protection side of the patients on the purpose of clinical ethics through the patient safety law. What is significant point of this paper is to present implications of the patient safety law through political considerations of the another countries for the norm of ethics.
This paper looks into the development and recent trends regarding to the patient safety in major foreign countries, in view of the strengthening tendency to expand the scope of duties and responsibilities in the doctor"s case law on the national and international medical liability, responds to healthcare patient safety system and the prevention of medical errors through discipline and responsibility. To this end, it is recently reviewed the highlights of the patient safety law enacted in our country, and legal discussion in clinical practice due to the enactment and medical disputes factor of the legal system in accordance with the legislative intent and to review the legal and institutional measures in advance. In addition, by reviewing clinical ethics and type of responsibilities related to patient safety incidents, and the features of Critical Incident Reporting Systems(CIRS), it is helping to patients for the quality management of health care and reviewed on the level of proper care and organization for the establishment of Patient Safety Culture and the adequacy of safety.
